2026 World Cup: Why Thomas Partey’s judicial review of Canada visa refusal failed

A Canadian Federal Court dismissed an urgent motion filed by Black Stars midfielder Thomas Teye Partey, upholding Canada’s refusal of his Temporary Resident Visa application ahead of the 2026 FIFA World Cup.

Justice Roger R. Lafrenière delivered the decision on June 16, 2026, in Ottawa. Partey had sought expedited court orders to either grant him entry or compel immigration authorities to reconsider his application quickly, arguing he needed to join Ghana’s squad for their World Cup match against Panama in Toronto.

The court declined the request, stating it “could not bypass established immigration processes or grant relief that would, in effect, substitute for a visa decision through an interlocutory motion.” The judgment emphasised that doing so would undermine procedural fairness by preventing immigration authorities from properly responding and completing required procedural steps.

Partey applied for a visa on May 21, 2026, under a FIFA-related invitation and was refused entry on June 10. Immigration, Refugees and Citizenship Canada (IRCC) cited inadmissibility concerns under Canada’s Immigration and Refugee Protection Act, specifically referencing ongoing criminal charges in the United Kingdom that could constitute indictable offences under Canadian law if proven.

Immigration officials also noted inconsistencies in his application, including initial declarations stating he had not been arrested or charged, followed by later submissions confirming he faced multiple charges.

Partey’s legal team argued the refusal was disproportionate and urged either humanitarian consideration or temporary entry clearance to fulfil his sporting commitments with Ghana at the tournament.

Justice Lafrenière ruled the threshold for exceptional relief had not been met. On the balance of convenience, the court concluded that “Canada’s interest in enforcing its immigration laws outweighed the request for expedited access.”
